Special damages and general damages explained

    Special Damages are awarded for the financial loss suffered and expense incurred by a Plaintiff as a result of the Defendant’s wrongdoing. They are often referred to as “out of pocket expenses”. They will include losses from the date of the injury to the hearing of the action and also losses, costs and expenses which will continue into the future as a result of an injury.

    There is no limit on the amount of Special Damages that can be claimed, however it is very important that it is fully supported. This is why we always engage the services of specialists to prepare reports on your behalf to support your claims for Special Damages.

    If you are successful in your case you will also be entitled to General Damages. General Damages is compensation for the pain and suffering the injured party sustained. They have been traditionally divided into two figures, one representing pain and suffering to date and the second for pain and suffering in the future.
