If you are hurt and you are considering a claim for personal injury compensation, there are some things that you should know. A personal injuries claim may be filed if you are injured because of an accident or other event. However, you must file your claim for personal injury compensation within two years from the date of the accident or event. If you do not file within that two-year period, you will not be allowed to file a claim. The two-year period is known as a Statute of Limitations.
There are a few exceptions to the two-year limitation:
- If the injured person was a minor (under the age of 18) when the accident or event occurred;
- If you did not know and could not have reasonably known you were injured;
- If you did know or could not have reasonably known who injured you; or
- If you file an injuries claim with PIAB and receive an acknowledgement letter during the two-year window, time is frozen until you receive an authorisation for court. When you receive the authorisation, the timer continues to run.
