Compensation for Whiplash
Whiplash compensation is estimated by the Personal Injuries Board depending on the amount of time it will take for it to heal. For minor whiplash that heals within 12 months, the estimate on compensation is €14,400. If it takes two years to heal, estimated compensation is between €11,500 and €15,700. For whiplash injuries that do not heal, which is around 20% of all whiplash injuries, estimated compensation is between €15,900 and €78,400.
Whiplash and Other Neck Injuries
Whiplash and other neck injuries fall under an area of Irish law known as personal injury. Personal injury can occur without what we would commonly refer to as an accident. Neck injuries can occur because of overuse of the muscles, sudden movements, and even problems with your posture. Yet, the most common cause of a serious neck injury is a road traffic accident. Usually, whiplash and other neck injuries are the most reported injury in road traffic accidents where a vehicle is hit from behind. Whiplash can cause severe effects, including:
- Fracture to the vertebrae;
- Neck pain;
- Temporary or permanent paralysis;
- Numbness;
- Aching muscles;
- Stiffness;
- Pain in the back or shoulders; and
- Muscle or joint stiffness.
Neck injuries, including whiplash, may often be thought of as minor, but their effects can last for a long time. Some people experience long-term disability. This type of injury can stop you from doing even daily tasks. You may even suffer when you simply try to turn your head from side to side.
